The text approved this Tuesday establishes that electronic games can be used for therapeutic purposes, for vehicle driving training and to simulate driving machines.

The project, signed by MP Kim Kataguiri (União-SP), regulates the production, importation, sale and development of electronic games in the country. The rapporteur of the economic commission, Senator Irajá (PSD-TO), made an editorial change to the text.

It included, within the scope of the regulatory framework, in addition to the “manufacture, importation, marketing, development and provision of entertainment services”, as it was in the original text, also “the commercial use of electronic games”.

According to the senator, the adjustment aims to give greater security to the market. “Trading in games is not limited to the acquisition of a license to use software, but also to the commercial use of trademarks associated with electronic games by licensing their use in various other ways, including organization of tournaments,” he said, in your report.

Since this is an editorial change – that is, a change that does not affect the merits of the project – the change does not oblige the text to return to the Chamber for a new analysis.

Furthermore, the text excludes slot machines and other games of chance from the definition of electronic games.

What does the text predict?

Fantasy games are those that take place in a virtual environment and involve the performance of athletes in real sporting events. The value of the prize must not depend on the number of participants or on the amount raised with the entry fee. Also, results cannot be derived from the scores or activity of an individual athlete or team in actual competition.

The indicative classification by age of the games will be the responsibility of the State. The text also exempts the development and exploitation of electronic and fantasy games from state authorisation.

The project allows the use and dissemination of data referring to results, statistics and name mentions related to real sporting events in the development of imaginative games.

According to the proposal, electronic games can be used for entertainment, for school activities with educational purposes, according to the common national curriculum basis, and for recreation.

It is also intended for therapeutic use and for training and simulations in driving vehicles, responding to emergency situations, and handling machinery and equipment.

The use of electronic games in schools, in therapy and in training and simulation will be regulated by the administrative authorities.
