AMLO orders the expropriation of the railway section conceded to Germán Larrea: Marina takes facilities

Mexico Groupthe fourth largest company in the country, reported that armed members of the Secretary of the Navy occupied the facilities of Ferrosur SA de CV in the Coatzacoalcos – Medias Aguas section from 6:00 a.m. local time this Friday, May 19.

“The surprising and unusual takeover of the facilities by the Armed Forces is being analyzed by Grupo México Transportes, its investors and advisers,” the company clarified via a relevant event, sent to the Mexican Stock Exchange (BMV). ).

He also clarified that the company will continue to provide service to its users without any assignment for the time being, only with the monitoring of the armed forces and timely information will be provided on the actions to be taken according to its obligations as as a public company. .

Mexico’s largest mining company, owned by German Larrea Mota-Velascor, he also mentioned that in the same way, in the Official Gazette of the Federation, the decree ordering the temporary and immediate occupation of the railway section by the Ferrocarril del Istmo de Tehuantepec SA de CV, a company with majority participation of the State, has been published .

What does the decree say?

According to the document published in the DOF, in its second article it is stated that the immediate temporary occupation is ordered in favor of Ferrocarril del Istmo de Tehuantepec, SA de CV, in its capacity as a member of the multimodal logistics platform in charge of the Interoceanic Corridor of the Isthmus of Tehuantepec, since:

The general railway communication routes that correspond to the railway sections that go from Medias Aguas to Coatzacoalcos, Veracruz de Ignacio de la Llave, with a length of 91,219 kilometers of line Z; from Hibueras to Minatitlán, Veracruz from Ignacio de la Llave, with a length of 11 kilometers that make up the ZA branch, and from Coatzacoalcos to El Chapo, Veracruz from Ignacio de la Llave, with a length of 18 kilometers from the FA line , detailed in the construction plan and tables in the recital of this decree.

While in the Fourth article it is specified that “the rights and obligations contracted with third parties by Ferrosur, SA de CV for the public service of transport of goods in the sections referred to in the SECOND article, paragraph a, will be assumed by Ferrocarril del Istmo de Tehuantepec, SA de CV of the occupation ordered in this decree”.

While the Sixth establishes that: “Ferrosur, SA de CV and the other legitimate and interested owners of the goods and rights that could be affected by this decree must be personally informed, at the address that appears in the corresponding file.”

In the event that it is not possible to notify personally, due to ignorance of the persons, their address or their location, make a second publication in the Official Gazette of the Federation, within five working days of the first publication, in accordance with Article 4 . of the law on expropriation, he adds.

In said publication it is also stated that “that, in short, it is necessary that the railway sections that go from Medias Aguas to Coatzacoalcos, from El Chapo to Coatzacoalcos and from Hibueras to Minatitlán remain in charge of Ferrocarril del Istmo de Tehuantepec, SA de CV, because they are ideal for direct and dynamic railway operation for the circulation of trains”.

Therefore, the Interoceanic Corridor of the Isthmus of Tehuantepec, based on various articles of the Expropriation Law, requested the Secretary of the Navy to process the issuance of the Declaration of Public Utility, the temporary occupation in favor of Ferrocarril del Istmo de Tehuantepec, regarding the rights and assets granted to Ferrosur, in the sections from Medias Aguas to Coatzacoalcos; from Hibueras to Minatitlán, and from Coatzacoalcos to El Chapo, from the state of Veracruz to Ignacio de la Llave.
